These Terms and Conditions govern your use of the HushAway® website, mobile application, audio content, services, subscriptions and related products (the “Services”). HushAway® is operated by Peace in Sounds Ltd (Company No. 17364669). By accessing or using our Services, creating an account, starting a trial or purchasing a subscription, you agree to be bound by these Terms. If you do not agree, you must not use the Services.

Important information
HushAway® is designed to support relaxation, emotional regulation, mindfulness and calming routines for children and families. It is not a medical device, healthcare provider, therapy service or emergency support service. The content is informational and wellbeing-focused only, and should not be considered medical, psychiatric, psychological or clinical advice. Parents, carers and settings remain fully responsible for supervising children using the Services. If you have concerns about a child’s health, wellbeing, behaviour or safety, seek advice from a qualified professional.

Eligibility and accounts
You must be at least 18 to create an account or purchase a subscription. Children may only access the Services under the supervision of a parent, guardian, teacher or authorised adult. You are responsible for keeping your login details confidential, for all activity under your account, and for keeping your information accurate. We may suspend or terminate accounts where these Terms are breached, misuse or fraud is identified, or behaviour is abusive or unlawful.

Subscriptions, trials and billing
HushAway® may offer free trials, monthly or annual subscriptions, or one-off purchases. Where a free trial is offered, payment details may be required and the subscription converts to paid unless cancelled before the trial ends. Subscriptions renew automatically unless cancelled before the next billing date. We may change pricing, with material changes communicated in advance.

Cancellation and refunds
You may cancel at any time through your account settings or by contacting us. Cancellation prevents future renewal charges, access continues to the end of the current billing period, and partial or prorated refunds are not provided. Under UK consumer law, digital content accessed immediately after purchase may not qualify for the standard 14-day cancellation period once access has begun. Nothing affects your statutory consumer rights.

Acceptable use and intellectual property
You agree not to use the Services unlawfully, copy or resell HushAway® content without permission, attempt unauthorised access, upload harmful code, or misuse the platform. All content within the Services, including audio, soundscapes, visuals, branding, logos, written content, design and software, is owned by or licensed to HushAway® and protected by intellectual property laws. You are granted a limited, non-transferable, non-exclusive licence for personal, non-commercial use only.

User content
If you submit reviews, comments, testimonials, survey responses or other content, you grant us a non-exclusive, royalty-free licence to use, reproduce and display it for operational, marketing, research or service-improvement purposes. You confirm the content is yours or you have permission to share it, does not infringe others’ rights, and is not unlawful, abusive, defamatory or misleading.

Privacy, third parties and availability
We process personal information in accordance with our Privacy Policy and applicable UK data protection law. The Services may contain links to third-party platforms, for which we are not responsible. We aim to provide uninterrupted access but do not guarantee continuous availability, and may update features, remove content, carry out maintenance or suspend access.

Liability, safeguarding and governing law
Nothing excludes liability where it would be unlawful to do so, including for death or personal injury caused by negligence, fraud, or breaches of statutory consumer rights. To the maximum extent permitted by law, HushAway® is not liable for indirect or consequential losses, loss of data or profits, or business interruption. Parents, carers and settings remain responsible for supervising children, assessing suitability, and ensuring safe use of devices and headphones. These Terms are governed by the laws of England and Wales.
